The Kane County Chronicle recently featured an article discussing a potential territorial expansion for the Fox River and Countryside Fire/Rescue District. This could happen at the expense of another neighboring fire district. Over the summer, voters submitted a petition to detach certain areas from the Elburn and Countryside Fire Protection District and integrate them into the Fox River district. According to court documents dated July 17, this move is being considered. Attorney Pat Griffin, representing the Fox River district, outlined the boundaries of the proposed territory, which are delineated by LaFox Road to the east, Anderson Road to the west, Campton Hills Road to the south, and Empire Road to the north. However, some agricultural land located just north of Silver Glen Road is also included. Approximately 128 individuals signed the petition to disassociate, but the population in the area totals around 3,000 residents. Griffin explained that this petition serves as a way for residents to place a question regarding the disconnection on the November 4 ballot. Griffin noted that a judge must review the petition and evaluate various factors, including whether the transferred territory would receive comparable services from the Fox River district and whether the disconnection would significantly harm the Elburn district. Last week, Kane County Circuit Judge David Akemann ruled that the conditions for the transfer and disconnection were satisfied, as stated in a court document dated August 28. "The Elburn FPD contends that evidence indicated there wouldn't be a proportional adjustment to expenditures to offset the loss of revenue," the document reads. "In fact, very little evidence was presented by any party regarding the impact of the disconnection on Elburn FPD expenditures." Griffin clarified that only residents within the specified territory will be eligible to vote on whether to leave the Elburn district. A simple majority is required for the disconnection process to continue. The referendum is scheduled for the Fox River district's special board meeting at 7 p.m. on September 3, 2014. The questions to be addressed are as follows: For transferring from the Elburn and Countryside Fire Protection District to the Fox River and Countryside Fire/Rescue District, while remaining accountable for a proportional share of the outstanding bonded debt of the district being disconnected, if applicable, as well as assuming a proportional share of the bonded debt, if any, of the receiving district.
